TERMS AND CONDITIONS OF USE AND RELEASE OF INFORMATION AUTHORIZATION

MyChart: One Place. One Record. One Reason. You.

UConn Health, John Dempsey Hospital, and UConn School of Medicine (collectively referred to as UConn Health) and the physician offices that participate in the UConn Health Electronic Health Information System are pleased to offer access to your medical information via a Web-based version of our computer systems called MyChart.

By accessing and using MyChart, you are agreeing to the following Terms and Conditions. If you do not agree to these terms and conditions, do not use MyChart.

1) MyChart Access

A. Patient Access.Access to MyChart at UConn Health is granted to patients for the purpose of furthering medical care at UConn Health. You will be provided with instructions for creating a unique personal login name and password. The login name and password you choose will be used to access your health information in MyChart and are unique codes that identify you in the application. UConn Health reserves the right to revoke patient access to MyChart at any time for any reason.

B. Proxy Access.A Proxy is a person who represents a patient. Proxy access to a patient’s medical information will be granted to the extent that the individual requesting Proxy access has the right to access the patient’s medical information and agrees to do so solely for the benefit of the patient. Separate MyChart accounts will be created for the Proxy and the patient. UConn Health reserves the right to revoke Proxy access at any time for any reason.

2) MyChart Use

A. DO NOT USE MYCHART IN AN EMERGENCY OR TO COMMUNICATE URGENT HEALTH MATTERS. In case of an emergency, call 911 immediately, or go to the nearest emergency room.

B.Do not rely on external links for treatment or diagnosis. MyChart may offer links to related medical websites not managed by UConn Health. These links are for informational purposes only. UConn Health does not endorse and has not verified the accuracy of the information on these websites, and you should not rely on any of the information found on the web sites for purposes of treatment or diagnosis.

C. Allow at least two (2) business days for response to electronic inquiries. UConn Health will use its best efforts to provide timely responses to inquiries made through MyChart. In some cases, the staff that needs to respond to an inquiry or other communication may not be immediately available. Please allow at least two (2) business days for a response.

UConn Health is only able to respond to your communications based on the information you provide. If insufficient information is provided, UConn Health will be unable to provide accurate and reliable services..

D. Consider your e-mail privacy.Patients who use MyChart will be notified via their patient-provided e-mail address when there is new medical information available in MyChart. Although UConn Health will not send private medical information to your e-mail, notifications relating to private medical information in MyChart will be sent to your e-mail. Any person with access to your e-mail, such as a spouse or an employer, will be able to see this notification. Take this into consideration when providing an e-mail address and update your e-mail in MyChart as necessary. UConn Health is not responsible for any damages resulting from a failure to verify and update your e-mail address in MyChart.

E. Read and respond to your MyChart messages.You must read and respond to messages in your MyChart Inbox in an appropriate time and manner. Messages that you send via MyChart may be sent to the appropriate department for handling. You acknowledge that UConn Health staff, other than your healthcare provider, may access these messages. UConn Health staff may also access your MyChart account as needed to respond to requests or support the operation of MyChart.

F. Contact your treating physician with questions. MyChart provides patients with access to documents such as reports, notes, lab results, and discharge documents that may need additional review and interpretation by their providers. These documents may be viewable on MyChart before your provider has the chance to discuss their content with you. If you have questions about such documents, call your treating physician.

3) Privacy & Security of MyChart Information

A. Privacy. UConn Health is committed to protecting the confidentiality of your medical information. We afford the same degree of confidentiality to medical information stored on MyChart as we give to medical information stored in your UConn Health electronic medical record or in any other medium. We limit UConn Health employees’ access and ability to view information based upon their role and job duties. Firewalls, passwords, encryption, and audit trails are used to further safeguard your information.

B. Security. For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal. Our SSL web server uses authentication and offers the highest level of encryption technology commercially available. You can tell when you have a secure connection by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the connection is secure. This means that your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to UConn Health by viewing the digital certificate. This certificate verifies the connection between the UConn Health server's public key and the server's identification.

C. Your Responsibilities. UConn Health is not responsible for damages if your acts or omissions result in the violation of the privacy of your medical information. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR MYCHART USERNAME AND PASSWORD. At minimum, you should take these precautions to keep your MyChart health information confidential and secure:

1) Do not share your unique identification or MyChart password with anyone.

2) Change your password and notify us immediately if you discover or suspect that someone is accessing your MyChart account without your permission.

3) Keep personal computers used to access MyChart in a safe place, password protected, and updated with antivirus protection.

4) If using a public computer to access MyChart, take safety measures to prevent the next user from accessing your MyChart information (e.g., log out of e-mail and MyChart before leaving the machine, and do not download any MyChart content to a public computer).

4) Availability, Accuracy, and Restrictions

A. Availability.UConn Health strives to keep MyChart convenient and available. MyChart may become unavailable due to system maintenance, back-ups, or technical failures. You are not guaranteed access to MyChart at any particular time and may only access MyChart when it is “available.”

B. Accuracy.Although MyChart displays certain health information about you, it does not necessarily display all information found in your medical record. You may request a copy of your complete medical record by contacting UConn Health’s Health Information Management Department at 860-679-2787. If you think that your health information displayed in MyChart is inaccurate, you can request that UConn Health amend your MyChart health information by messaging your provider within MyChart.

C. Restrictions.You must not use MyChart for fraudulent, harassing, offensive, threatening, or illegal activity. Unauthorized use of MyChart may result in a claim for damages and/or be a criminal offense. If UConn Health suspects that you are using MyChart for fraudulent or inappropriate activity, it has the right, and is the only one who can decide, for any reason, to revoke your MyChart access. UConn Health can also revoke your MyChart access if it suspects these types of activities are associated with the account. UConn Health may revoke your MyChart access without notifying you in advance. UConn Health has the right to investigate and notify law enforcement of any fraudulent or inappropriate activity associated with your MyChart account.

5) Account Cancellation

You can terminate your MyChart account at any time by navigating to the Messages tab, click 'Ask a Question,' choose 'Customer Service Question' and select 'Account Deactivation Request' from the options. 6) Copyrights & Trademarks

U.S. and international copyright law and conventions may protect all content included on MyChart and any UConn Health site. This content includes but is not limited to: text; photographs; graphics; button icons; images; artwork; names; logos; trademarks; service marks; and data. Direct or indirect reproduction of this content, in whole or in part, by any means, is prohibited.

7) Disclaimer of Warranty & Limitation of Liability

UConn Health provides MyChart “as is” and “as available,” and without any warranty. UConn Health disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, with respect to MyChart; without limiting the generality of the foregoing, UConn Health does not warrant that MyChart will be uninterrupted or error free; or that any defect or error will be corrected; or that MyChart will be secure and free of viruses or other harmful components; or that any information provided on MyChart will be current or accurate; or that a particular product, service or provider you see on MyChart will be available to any user. If you choose to use MyChart you should not rely on any such warranty of any kind; and your use of MyChart, and any information, goods or services obtained through MyChart, is entirely at your own risk.

MyChart may contain links to third party websites. The linked sites are not under UConn Health’s control. UConn Health is not responsible for the contents of any linked site. We provide these links as a convenience only, and a link does not imply endorsement of, sponsorship of, or affiliation with UConn Health. You should make whatever investigation you feel necessary or appropriate before relying on any of these third-party websites. If you are not happy with MyChart, there is only one solution: stop using MyChart and its services.

8)Choice of Law

By using MyChart, you agree that these Terms and Conditions shall be construed in accordance with and governed by the laws of the State of Connecticut, without regard to its conflict of law principles. You further acknowledge that the sole and exclusive means for the presentation of any claim against UConn Health, the State of Connecticut and/or their agencies, departments, their officers or employees arising in connection with MyChart or these Terms and Conditions, shall be in accordance with Chapter 53 of Connecticut General Statutes. Nothing herein shall be construed as a modification, compromise or waiver of any rights or defenses of immunities provided by federal or state law, which UConn Health, the State of Connecticut and/or their agencies, departments, officers or employees may have had, now have or will have with respect to all matters arising out of the Terms and Conditions.

10) Proxy MyChart access

Using MyChart on behalf of another person is called Proxy Access. Proxy access allows adults age 18 and older to access another person’s medical information through their own MyChart account. Such information may include information associated with HIV, mental health, and drug and alcohol treatment. If you are accessing someone else's MyChart information through Proxy access, you also agree to be bound by the Proxy Terms and Conditions. Parental Proxy access to a minor’s medical information in MyChart will vary in accordance with Connecticut law based upon the age of the minor. The amount of information the parent will be able to see depends on the age and legal status of the minor.
